Terms of Service

1 Scope and acceptance
These Terms of Service govern traqgolf.com, purchases of TRAQ physical products, and the TRAQ PLAY app and related account, scoring, and tournament services. Aethon Sports LLC, doing business as TRAQ Golf (TRAQ, we, us, or our), provides these offerings. You means the person using the relevant offering.
When you affirmatively agree to these Terms through an account, purchase, or other acceptance process, you agree to the provisions relevant to your use. Acknowledging the Privacy Policy does not provide consent to optional marketing, location, health, or notification permissions. The Privacy Policy at https://www.traqgolf.com/privacy explains how we handle personal information.
Sections 2 and 4 distinguish app eligibility from physical-product rules. The PLAY provisions apply to PLAY, and physical-product restrictions apply to physical purchases. These Terms apply prospectively and do not retroactively alter an existing dispute or rights and obligations that arose earlier.
2 Eligibility and launch availability
You must be at least 13 to use TRAQ PLAY. At launch, TRAQ PLAY is offered only in the United States. Do not misrepresent your age or location, evade an eligibility restriction, or use another person’s account to obtain access you are not entitled to have. App Store availability alone does not establish that every feature is lawful in your location.
If you are under 18, review these Terms with your parent or legal guardian and use PLAY only with their permission.
Eligibility for ordinary golf scoring does not establish that a particular use of a feature is lawful. Physical-product purchasers must be at least 18.
3 Free PLAY launch
All TRAQ PLAY features are free at launch. These Terms do not enroll you in a subscription or authorize a charge for PLAY. Your mobile or internet provider may charge for connectivity. Physical products remain separately priced purchases under Section 4.
4 Physical products and store purchases
Safety. Aerosol golf training aids are for golf mats or grass, outdoors or in well-ventilated areas. Contents are flammable: avoid heat, sparks, flames, and hot surfaces. Do not puncture or incinerate cans. Avoid inhalation and eye or skin contact. Keep away from children and pets. Follow labels; misuse can cause injury or property damage.
Shipping. Physical orders ship only within the contiguous United States, excluding P.O. boxes and APO/FPO addresses. Alaska, Hawaii, and international destinations are excluded. Orders outside these limits are canceled and refunded.
Orders. Prices and availability may change without notice. We may refuse or cancel orders, limit quantities per customer, household, or order, and update or discontinue products, subject to applicable law. Canceled paid orders are refunded.
Returns. Request a return within 30 days of delivery. Items must be unopened, unused, and in original packaging. Opened, used, or damaged cans are not eligible for ordinary returns. You pay return shipping unless the item was incorrect or defective. After inspection, eligible refunds go to the original payment method. These rules do not remove statutory remedies for defective or misdescribed goods.

Accounts content and fair use
5 Accounts and security
Provide accurate account information and keep it reasonably current. Access only accounts you are authorized to use. Protect your device and sign-in-provider credentials. Do not share account access in a way that exposes another person’s information. You are responsible for activity you authorize through your account, subject to applicable law; you are not automatically responsible for every unauthorized action.
Report suspected unauthorized access to support@traqgolf.com. Never send passwords or verification codes. We may require reasonable verification before discussing account information or carrying out a request.
6 Software license and intellectual property
TRAQ and its licensors retain their rights in the website, app, software, design, branding, and content they supply. Subject to these Terms, you may use the website and PLAY for your own lawful golf activities, including organizing rounds and tournaments with the available features. This permission does not transfer ownership or permit resale, unauthorized copying, or commercial exploitation.
The applicable App Store end-user license agreement governs the iOS software license. Apple’s standard agreement applies unless TRAQ has supplied a valid custom agreement for the relevant territory. These Terms govern the TRAQ service relationship and do not override rights or obligations required by the applicable software license or law.
7 Your content and sharing
You retain your rights in the profile information, photos, scores, round details, reviews, feedback, and other material you submit (Your Content). Submit only material you have the right to use and share. Do not impersonate another player or enter another person’s private information without authority.
You grant TRAQ a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, and display Your Content only as reasonably needed to provide, secure, maintain, and support the relevant offering, including showing shared gameplay records to their intended audience. Service providers may assist for those purposes under appropriate obligations. This license does not authorize advertising use of Your Content without separate permission.
The license lasts only as long as reasonably necessary for those purposes, subject to applicable deletion obligations and permitted retention described in the Privacy Policy. It does not transfer ownership of Your Content to TRAQ.
Public tournament leaderboard links can be viewed without a TRAQ account. They display player names and scores, and recipients can forward the link to others. Before entering a tournament or sharing a link, consider that audience. Do not assume that copies made by other people can be recalled. The Privacy Policy explains other player-to-player visibility.
8 Acceptable use and reports
Do not threaten, harass, defraud, exploit, or unlawfully discriminate against anyone; submit unlawful, infringing, defamatory, or misleading material; expose someone’s private information; or deliberately falsify results to deceive other players.
Do not interfere with security or operation, introduce malicious code, send spam, scrape personal information, bypass access controls, or access systems without authorization. Do not reproduce, distribute, or modify TRAQ material without permission. Restrictions on reverse engineering and similar activity apply only to the extent permitted by law.
We may investigate credible reports, restrict harmful content, and take proportionate action against misuse, without promising continuous review. Report concerns to support@traqgolf.com with sufficient detail and no unnecessary personal information.
Gameplay stakes and tournaments
9 Scores handicaps and game calculations
Scores, handicap allocations, game results, statistics, and stake calculations depend on player inputs, chosen settings, course information, and the app’s implementation of a game format. Review those inputs and results. Agree with your group on rules, tees, handicaps, presses, corrections, and incomplete rounds before relying on a result.
TRAQ PLAY helps record and calculate information; players or the tournament organizer resolve disputes about entered scores and agreed rules. Contact support if you believe a calculation is incorrect. Any TRAQ-generated index is an estimate and must not be represented as an official GHIN or USGA Handicap Index. An externally supplied handicap remains subject to its issuer’s rules and the organizer’s eligibility requirements.
10 Match stakes and outside app settlement
Where available and lawful, PLAY records participant-entered match stakes, presses, and results and calculates amounts between players. TRAQ does not hold, process, transfer, or settle match money. Any exchange of money takes place outside the app between the participants. TRAQ does not collect a balance for you or guarantee that another participant will pay.
An entry or calculated amount does not establish that a wager or payment obligation is lawful or enforceable. Do not use PLAY for unlawful wagering, to evade age or location restrictions, or to organize an activity requiring an authorization you do not hold. TRAQ may restrict or disable functionality to comply with law, platform requirements, or material safety concerns.
11 Tournaments and public leaderboards
Organizers are responsible for communicating their tournament’s participation requirements, format, scoring rules, and leaderboard audience. Organizers must have authority to share participant information through the features they use, including public links. Participation may be subject to separate event rules that do not reduce TRAQ’s obligations under these Terms.
Do not use PLAY to run an unlawful promotion, contest, lottery, or paid gaming activity. Do not collect entry payments or promise prizes on TRAQ’s behalf. A player-organized event is not automatically sponsored by TRAQ. Any TRAQ-sponsored promotion needs separately approved rules and applicable platform disclosures.
12 Course location and activity information
Course information, maps, distances, and location-based information may be incomplete or inaccurate. Verify conditions, obey course rules, and stay aware of players, vehicles, hazards, and your surroundings. Do not use PLAY while driving or whenever doing so would be unsafe.
Where enabled, optional health or activity information is for general golf and fitness tracking, not medical diagnosis, treatment, or emergencies. Location, health, and notification permissions are separate from accepting these Terms. Device capabilities, operating-system versions, external services, connectivity, and permissions may affect access. Third-party services have their own terms; a link does not imply endorsement.
Service rights disputes and contact
13 Availability suspension and ending use
We may update or discontinue features to maintain security, fix defects, comply with law, or improve the service. Where reasonably practicable, we will give notice of a significant discontinuation. We do not promise uninterrupted access or error-free information.
You may stop using PLAY and request account deletion as described in the Privacy Policy. Uninstalling the app does not delete your account. Deletion, retained data, and shared records are subject to applicable law and the Privacy Policy.
We may suspend or end access when reasonably necessary to address a material breach, illegal activity, fraud, a security risk, or harm to others. Where appropriate and lawful, we will explain the reason and provide an opportunity to correct or challenge the decision through support. Urgent cases may require immediate action. Ending use does not remove existing legal rights; provisions needed to address accrued rights or disputes survive only as necessary.
14 Warranties and mandatory rights
To the extent permitted by law, products and services are provided as is and as available, without additional implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that they will meet every individual expectation. Nothing here excludes a warranty, duty of reasonable care, consumer remedy, or liability that cannot lawfully be excluded or limited.
15 Liability
TRAQ’s liability is determined under applicable law. Nothing in these Terms excludes or limits a liability or remedy that cannot lawfully be excluded or limited.
16 Complaints governing law and disputes
For a complaint, contact info@traqgolf.com and explain the issue and requested resolution. We encourage good-faith efforts to resolve concerns directly. This does not delay urgent relief or limit rights that cannot lawfully be waived.
These Terms are governed by California law, except where mandatory law requires otherwise. You or TRAQ may bring a claim in a court with lawful jurisdiction. These Terms do not require arbitration or waive participation in a class or representative action. Applicable statutory filing deadlines remain unchanged.
17 Communications and changes
We may send necessary order, account, security, and service communications. Optional marketing requires the applicable opt-in and can be unsubscribed from separately. An unsubscribe does not stop necessary transactional messages.
We may update these Terms. For changes that materially affect your rights or obligations, we will provide reasonable advance notice through a prominent in-app notice or email, identify the changes and their effective date, and request renewed agreement where required by law. We may post nonmaterial changes on this page with an updated effective date. Changes apply prospectively and do not alter an existing dispute or rights and obligations that arose before the changes took effect. If you do not agree to a material change, you may stop the affected use without losing rights preserved by law. If a provision is unenforceable, the remainder continues so far as legally permitted.
